Sealed Bids for the purchase of rights to the Long Island Power Authority’s 2008 Natural Gas Therm Savings and Documentation will be publicly opened and read by The Long Island Power Authority at its Executive Offices at 333 Earle Ovington Boulevard, Suite 403, Uniondale, NY 11553, New York at 11:00 a.m. on Monday April 6, 2009.
All bids must be made on Long Island Power Authority bidding sheets only.
The Authority reserves the right to reject any and all bids, to waive any
informality in any bid, and to accept the bid of the highest responsible
bidder, as determined by LIPA after all bids and bidders have been examined
and checked.
In accordance with Section 112 of the New York State Finance Law (the “State
Finance Law”), this Agreement shall not be valid, effective or binding upon
LIPA until it has been approved by the State Comptroller and filed in his
office.
Pursuant to State Finance Law sections 139-j and 139-k, this Bid includes
and imposes certain restrictions on communications between LIPA and
Proposers during the procurement process. A Bidder is restricted from making
“Contacts” (i.e., an oral, written or electronic communications which a
reasonable person would infer as an attempt to unduly influence the award,
denial, or amendment of a contract) from issuance of the Bid through final
award and approval of the resulting Procurement Contract by LIPA and the
Office of the State Comptroller (“restricted period”) to any LIPA staff (or
consultants) other than as designated herein, or to any LIPA Board member,
unless it is a contact that is included among certain statutory exemptions
as set forth in State Finance Law section 139-j(3) (a). LIPA’s designated
contacts for this, as of the date hereof, are William Funk, Contract
Specialist 516-719-9235 and Michael Standridge, Director of Corporate
Contracts and Procurement 516-719-8620. LIPA employees other than the
designated contact are required to obtain and document certain information
when contacted during the restricted period. Such Contacts will be
considered by LIPA when making a determination of the responsibility of the
Bidder pursuant to these two statutes. Certain findings of
non-responsibility can result in rejection for contract award, and in the
event of two findings within a 4-year period, the Bidder is debarred from
obtaining governmental Procurement Contracts. Further information about
these requirements will be provided via separate addenda to this Bid.

Any questions regarding this Bid should be submitted in writing and
faxed to Mr. William Funk, Contract Specialist at 516-719-9812 on or before
March 31, 2009. Responses to any questions received will be posted on
LIPA’s website at www.lipower.org as
they are received. No other communication of questions and answers will be
made. Bids are to be submitted on the prescribed formal Sealed Bid form
included herein.
